PARTY WALL MATTERS
If you are intending to develop an attached property, a site or own a property next to a proposed development it is likely that works are notifiable under various sections of the Party Wall Act.
The Act enables ‘Building Owners’ to develop new and existing structures up to a boundary, whilst protecting the rights of ‘Adjoining Owners’ from any losses that might occur as a consequence of works on an adjacent site.
The Act was not designed to hinder or restrict building works but help people to develop properties by giving them certain rights regarding repairing and maintaining party walls. In return for these rights, prior to construction the building owner must formally communicate their intentions to their neighbours. This formal communication is achieved via a system of notices that are served to neighbours holding legal interests in the adjoining properties.
Because any failure to serve an appropriate notice can result in legal action against any individual carrying out works, the RICS recommends that property owners take advice from a qualified Chartered Surveyor when considering any party wall works. The RICS advises that only Chartered Surveyors are utilised as RICS regulated firms provide further protection to clients working under the Act.
Schedules of condition are also often prepared before party wall works commence. The schedule of condition is used to determine whether the neighbouring building works have had any adverse effect on the property during or after their completion.
